These Terms of Service govern your use of www.packwheel.com and any purchase from Pack Wheel Products, LLC, doing business as Pack Wheel. By visiting the website, creating an account, placing an order, or otherwise using our services, you agree to these Terms.
1. Online Store Terms
You may use the website only for lawful purposes and in accordance with these Terms. You may not use the website or our products in a way that violates applicable law, infringes the rights of another person, or interferes with the security or operation of the website.
You may not introduce viruses, malicious code, automated scraping tools, or other technology intended to damage, disrupt, overload, or gain unauthorized access to the website or related systems.
We may refuse service, limit purchases, suspend accounts, or cancel orders where permitted by law, including in cases involving suspected fraud, abuse, policy violations, or security concerns.
2. Product Information and Availability
We make reasonable efforts to display product descriptions, photographs, specifications, compatibility information, prices, and availability accurately. However, product information may occasionally be incomplete, outdated, or incorrect.
Product colours and appearances may vary by screen, device, lighting, manufacturing batch, and normal product updates. We may modify or discontinue products, specifications, features, or prices without notice, subject to applicable law.
Products may become unavailable after an order is placed. If this occurs, we may contact you about a delay, partial shipment, substitution, cancellation, or refund. You may request cancellation of an unavailable item at any time before it ships.
3. Orders and Acceptance
An electronic or other order confirmation means that we received your order. It does not constitute acceptance of the order or confirmation of an offer to sell.
We reserve the right to accept, decline, cancel, or limit an order after it is submitted. Reasons may include product availability, quantity limits, pricing or description errors, payment issues, shipping restrictions, suspected fraud, or other reasonable business considerations.
If we cancel all or part of an order after payment has been collected, we will refund the cancelled amount to the original payment method.
You agree to provide current, complete, and accurate billing, shipping, account, and contact information. Incorrect information may delay processing or prevent fulfilment.
4. Pricing and Payment
Prices are shown in the currency displayed on the website and may change without notice. Applicable discounts, shipping charges, taxes, duties, and other charges are shown during checkout when available.
We accept the payment methods displayed at checkout. Pack Wheel does not add a surcharge solely because you use a credit card. Your bank, card issuer, financing provider, or payment service may impose its own fees under its agreement with you.
If a product is listed at an incorrect price because of a typographical, technical, supplier, or pricing error, we may refuse or cancel the affected order, including after confirmation. If payment has already been collected, we will refund the amount paid for the cancelled item.
5. Taxes, Duties, and Import Charges
Applicable sales taxes are calculated and collected where required. International orders may be subject to customs duties, import taxes, brokerage fees, or other government charges. Unless checkout states otherwise, those charges are the customer’s responsibility.
6. Shipping and Delivery
Most in-stock orders are expected to ship by the next business day. Orders are generally not processed or shipped on Saturdays or Sundays unless prior arrangements have been made.
Delivery dates and transit times are estimates and are not guaranteed. Delays may occur because of inventory availability, carriers, weather, customs, incorrect addresses, natural events, labour disruptions, or other circumstances outside our reasonable control.
For orders containing multiple products, we will make reasonable efforts to ship the items together. Products may be shipped separately as they become available. You will not be charged more for shipping than the amount accepted during checkout unless you approve the additional charge.
Customers are responsible for providing a complete and accurate delivery address. Contact us promptly if an address correction is needed. We cannot guarantee changes after an order has entered processing or has been transferred to a carrier.
7. Returns, Refunds, and Warranty
Returns, refunds, and warranty claims are governed by the Pack Wheel Warranty and Return Policy posted on the website. The policy includes a 21-day return window, product-condition requirements, a 15% restocking fee, and limited warranty terms for eligible Pack Wheel products and components.
Nothing in these Terms limits rights or remedies that cannot legally be limited or waived.
8. Product Use and Safety
Pack Wheel products are designed to assist with hauling gear and game meat. Product use may involve backcountry travel, uneven terrain, heavy loads, mechanical components, and other inherent risks.
You are responsible for reading and following product instructions, inspecting the product before use, performing appropriate maintenance, securing loads correctly, observing all stated weight and usage limits, and using reasonable caution and judgment.
9. Third-Party Services and Links
The website may use or link to services operated by third parties, including payment processors, shipping carriers, financing providers, analytics providers, social platforms, and other websites.
We do not control third-party services and are not responsible for their availability, content, privacy practices, terms, products, or services. Your use of a third-party service is subject to that provider’s terms and policies.
10. Intellectual Property
Unless otherwise stated, the website and its content, including text, product descriptions, photographs, videos, graphics, logos, icons, designs, trademarks, and their selection and arrangement, are owned by or licensed to Pack Wheel.
You may use website content only for personal shopping, product research, or placing an order. You may not copy, reproduce, modify, republish, distribute, transmit, sell, or commercially exploit website content without our prior written permission.
11. User Content and Communications
When you submit a review, photograph, comment, suggestion, feedback, or other content, you confirm that you have the right to submit it and that it does not violate applicable law or another person’s rights.
You may not submit content that is unlawful, abusive, misleading, defamatory, infringing, malicious, or designed to interfere with the website. We may remove content that violates these Terms or applicable law.
12. Disclaimer of Warranties
Except for express warranties stated in the Pack Wheel Warranty and Return Policy and except where prohibited by law, the website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, complete, or error-free.
Product descriptions and general website content are provided for informational purposes and do not replace product instructions, safety guidance, or the user’s responsibility to determine whether a product is appropriate for a particular use.
13. Limitation of Liability
To the fullest extent permitted by law, Pack Wheel Products, LLC and its owners, officers, employees, representatives, suppliers, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, an order, delayed delivery, inability to use a product, or product use.
Where liability cannot be excluded, it will be limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold Pack Wheel Products, LLC harmless from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or your infringement of another person’s rights.
15. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of that provision or any other right.
16. Governing Law
These Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law principles, except where the mandatory laws of your place of residence apply.
17. Changes to These Terms
We may update these Terms to reflect changes to our products, services, website, or legal obligations. The revised Terms become effective when posted with a new effective date, except where additional notice or consent is required by law.
